These General Terms of Use (hereinafter "Terms") govern the use of the Kilimara mobile application (hereinafter "the Application"), published by PAWALP. By accessing or using the Application, you (hereinafter "User" or "you") unconditionally accept these Terms. If you do not agree with these Terms, please stop using the Application.
The Kilimara Application is a platform that allows users, including farmers, cooperatives, and buyers, to post and view listings for food products, manage their agricultural activities, and benefit from traceability and marketplace features. The Application aims to facilitate transactions and the exchange of information in the agricultural sector.
2.1. Eligibility: To use the Application, you must be at least 18 years old or have the authorization of a legal representative. You must also have a mobile device compatible with the Application.
2.2. Registration: Access to certain features requires the creation of a user account. During registration, you agree to provide accurate, complete, and up-to-date information, such as your first name, last name, phone number, email address, geographic location, and details about your farm or agricultural business.
2.3. Account Responsibility: You are responsible for maintaining the confidentiality of your login credentials (username and password). Any activity conducted through your account is considered your responsibility. In case of unauthorized use of your account, you must immediately notify PAWALP at: contact@pawalp.com.
3.1. Authorized Use: You agree to use the Application in accordance with applicable laws and these Terms. Any fraudulent, abusive, or illegal use is strictly prohibited.
3.2. Listings and Transactions: Users may post listings to sell or buy products through the Application. You are responsible for the accuracy of the information provided in your listings (products, quantities, prices, etc.). PAWALP does not act as a party to transactions between users and does not guarantee the quality, quantity, or compliance of the products exchanged.
3.3. User Content: Any content posted on the Application (listings, messages, etc.) must comply with applicable laws and must not be defamatory, offensive, or illegal. PAWALP reserves the right to remove any inappropriate content without prior notice.
Payments made through the Application are managed by third-party service providers. PAWALP neither stores nor directly accesses users' sensitive financial information. You agree to the terms of use of third-party payment providers when conducting transactions.
All content, trademarks, logos, designs, and features of the Application are the exclusive property of PAWALP or its licensors. Any unauthorized reproduction, distribution, or use is strictly prohibited unless expressly authorized by PAWALP.
6.1. The Application is provided "as is," without any express or implied warranty regarding its availability, uninterrupted operation, or suitability for a particular purpose.
6.2. PAWALP shall not be liable for direct or indirect damages, data loss, business losses, or any other harm resulting from the use or inability to use the Application, except in cases of proven gross negligence or intentional misconduct.
6.3. PAWALP is not responsible for transactions between users, including the quality of products, disputes, or fraud.
The collection, use, and sharing of users' personal data are governed by PAWALP's Privacy Policy, which you accept by using the Application. For more information, please consult our Privacy Policy.
8.1. By the User: You may stop using the Application at any time and request the deletion of your account by contacting contact@pawalp.com.
8.2. By PAWALP: We reserve the right to suspend or terminate your access to the Application in case of violation of these Terms, fraudulent activities, or for any other legitimate reason, with or without prior notice.
PAWALP may modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. We recommend regularly reviewing this page to stay informed of any changes. Continued use of the Application after the publication of changes constitutes acceptance of the updated Terms.
These Terms are governed by the law applicable in the country where PAWALP is headquartered. Any dispute related to the use of the Application will be subject to the competent jurisdiction in the country where PAWALP is headquartered.
